Do You Need Two Witnesses for a Will in India?

Under Section 63 of the Indian Succession Act, a Will must be attested by at least two witnesses who see you sign it and then sign it themselves in your presence.

  • You need two witnesses, present at the same time.
  • Each witness must actually see you sign the Will.
  • A witness should NOT be a beneficiary — it can void their inheritance.
  • Witnesses should add their name, signature and address.

Choosing neutral witnesses (not family members who inherit) keeps your Will strong and hard to challenge.
