The Will
What is a Will?
A Will is a document in which a person sets out how they want their property distributed after their death. It lets you decide who inherits what, rather than leaving it to the law.
Why do I need to write a Will?
A Will ensures your assets are distributed according to your wishes, lets you appoint a guardian for your children, and lets you name an executor to manage the distribution. Without one, a court appoints an administrator and the law decides who inherits.
What if I die without making a Will?
Your estate is distributed only among close family as defined by succession law — potentially excluding friends, distant relatives or causes you would have wanted to provide for.
My assets are held jointly. Do I still need a Will?
Yes. Even jointly-held assets can pass to several relatives under succession law — based on your religion — not automatically to your spouse. A Will removes that uncertainty.
What happens if I don't sign my Will?
Unless a Will is signed, it is not a legally valid document. It must be signed by you in the presence of two witnesses.
Do I need to print my Will on stamp paper?
No — stamp paper is not mandatory for a Will. Printing it on good-quality ledger paper and registering it, however, adds to its authenticity.
Beneficiaries
Who is a beneficiary?
A beneficiary is a person or entity named in your Will as an inheritor of your assets.
Who can I include as beneficiaries?
Your spouse, children, grandchildren, friends, relatives — and institutions such as schools, trusts or charities.
Can I exclude immediate family members?
You may exclude family from your self-acquired assets. Different rules can apply to inherited or ancestral property, so take care there.
Can a witness or executor also be a beneficiary?
Preferably not. It is cleaner and safer if your witnesses and executor are independent of the people who inherit.
Executor
Who can be appointed as an executor?
Anyone you trust, other than a beneficiary. OnlineWILL also offers corporate executorship as a neutral third party.
How many executors should I appoint?
Ideally one primary executor and one backup — for example, a trusted individual plus OnlineWILL as the alternate.
Can OnlineWILL prepare my Will and also act as executor?
Yes. We provide both the advisory and drafting of your Will and, if you wish, executorship services.
Guardian for minors
Is it mandatory to appoint a guardian?
If you have minor children it is essential, because minors cannot legally hold title to property. A guardian manages their inheritance until they come of age.
Who should be appointed as guardian?
Someone trustworthy and over 18 — a family member, relative or close friend. You may name more than one.
Changes & amendments
What if I need changes to my Will?
Simply request the changes and we revise and resend the draft. Your Will is saved as you go, so you can update any step at any time.
Will I be charged every time I make changes?
There is no charge for the initial revisions to your draft. Substantial changes later may attract applicable fees.
Can changes be made after registration?
Yes — through a Codicil, a short amendment made during your lifetime that can itself be registered.
Registration & safekeeping
Is registration mandatory?
No. A Will is valid without registration. Registering it at the Sub-Registrar's office simply adds to its authenticity and evidentiary value.
What do I do once it's signed and witnessed?
Keep it somewhere safe at home, or in safe custody with Terentia Consultants, OnlineWILL's parent company.
Validity & eligibility
Who is OnlineWILL for?
OnlineWILL is designed for Indian citizens and non-residents (NRIs). A Will executed outside India may need attestation at the relevant Indian Consulate.
I already have nominations. Do I still need a Will?
Yes. A nominee only holds an asset in trust — your Will decides who actually owns it. A comprehensive Will records all your assets in one place and prevents disputes.
Payment & data security
Is the payment mode secure?
Yes. Payments run through a secure gateway; your card details are never stored by OnlineWILL — they are handled only by the bank's payment processor.
How will I know my payment was received?
You receive a confirmation email with a reference number you can quote for any future queries.
Is my personal data secure?
OnlineWILL uses advanced technology and encryption to keep your personal data secure. It is stored electronically and accessible only to you.
Is it safe to disclose my assets on the site?
Yes. Your asset details are encrypted, stored securely and visible only to you — never sold or shared.
